Развитие взаимоотношений государства и Церкви в Российской империи во второй половине XIX — начале XX века
Аннотация
В статье рассматриваются исторические и правовые аспекты взаимоотношений государства и церкви во второй половине XIX — начале XX века. Автор анализирует модель государственно-церковных отношений и правовой статус церкви с позиций как государственного, так и церковного права путем систематизации подходов ученых-канонистов к типологии церковно-государственных отношений и анализа ключевых правовых актов, закреплявших их в Российской империи. Исследование показывает динамику развития этих отношений: от фактического слияния церкви и государства под эгидой единой верховной власти к статусу церкви как государственного института и в конечном итоге к ее отделению от государства. Автор приходит к выводу, что развитие науки церковного права неразрывно связано с историко-правовым контекстом эпохи: к концу XIX века, под влиянием общественных и законодательных трансформаций, предметная область церковного права значительно расширилась.
